Rental Application Terms of Use
These terms govern your use of the online rental application operated by Savoy Real Estate Services LLC, doing business as Savoy Residential ("Savoy," "we"), on behalf of the owner of the community you are applying to. By checking the required agreement box and submitting an application, you accept these terms. Our Privacy Policy explains how we handle your data and is part of these terms.
1. Eligibility
You must be at least 18 years old to submit an application. Every person 18 or older who will live in the home must apply. Minors are listed as occupants by an adult applicant.
2. Accuracy of Information
Everything you submit must be true, complete, and current. Providing false, incomplete, or misleading information (including as to identity, income, employment, or rental history) is grounds for denial of the application, and if discovered after move-in, may be grounds for termination of the lease as provided in the lease and Texas law.
3. Fees and Payments
- Application fee: $75 per applicant. The application fee covers the cost of processing and screening and is non-refundable once screening has begun. If we reject your application without having provided the tenant-selection-criteria notice described in Section 5, Texas Property Code § 92.3515 entitles you to a refund of the application fee.
- Administration fee: $100 per application, where charged. Communities may waive or discount it in promotions; the amount due is itemized on the payment step before you pay.
- Statement descriptor: fees are processed by Stripe and will appear on your card statement as SAVOY RESIDENTIAL. Please recognize this descriptor before initiating a chargeback; billing questions go to the contact in Section 13.
- We never see or store your card number; payment details are entered directly with Stripe, our payment processor.
4. No Reservation Until You Submit and Pay
Selecting a unit in the application does not reserve it. Availability and pricing can change at any time before you complete submission and payment. The application shows you a freshness check before payment; if your selected home becomes unavailable, you may pick another without starting over. A unit is taken off the market only per the community's hold policy after your completed application and payment are received.
5. Resident Qualifying Criteria
The community's Resident Qualifying Criteria are presented in the application and are incorporated into these terms by reference. They describe the grounds on which an application may be denied (including criteria relating to criminal history, credit history, rental history, income, and falsified information) as contemplated by Texas Property Code § 92.3515. You must acknowledge the criteria before submitting. If you do not meet the criteria, your application may be denied and the application fee is not refunded (Section 3).
6. Screening Consent
By submitting, you authorize Savoy and the property owner to obtain consumer reports about you through our screening provider, Vero, including credit reports, criminal-history records, and rental/eviction history, for the purpose of evaluating your application, and to re-verify information you provided (employment, income, residence history). This authorization is made under the federal Fair Credit Reporting Act. If we take adverse action based in whole or in part on a consumer report, you will receive the notices the FCRA requires, including the name of the reporting agency and your right to a free copy and to dispute inaccuracies.
7. Guarantors
If a guarantor supports your application: the guarantor submits their own application and consents to the same screening; the guarantor agrees to guarantee the lease obligations as set out in the guaranty agreement signed at lease execution; guarantor income requirements are set out in the Tenant Selection Criteria. A guarantor is not an occupant and acquires no right to occupy the home.
8. Electronic Records and Signatures
You consent to conduct this transaction electronically. Your electronic acknowledgments and signatures in this application have the same effect as ink signatures under the federal E-SIGN Act and the Texas Uniform Electronic Transactions Act (Tex. Bus. & Com. Code ch. 322). You consent to receive application-related records and notices electronically at the email you provide. You may request a paper copy or withdraw electronic consent by contacting us (Section 13); withdrawal does not affect actions already taken. To use the application you need a current browser, an email account, and the ability to view and retain PDFs.
9. Communications
- Transactional messages: by providing your phone number and email, you agree we may contact you about your application, tours, and lease (confirmations, reminders, requests for missing items), including by SMS. Reply STOP to end texts; message and data rates may apply. See our SMS Terms & Conditions.
- Marketing messages: marketing SMS and email are separate, optional consents at submission. Declining them never affects your application.
10. Draft Applications Are Saved As You Type
The application saves your progress to our servers as you type, before you submit. We do this so you can resume on any device and so our leasing team can help you finish: if you start an application and do not complete it, we may contact you using the contact details you entered, to follow up or assist. Draft data is handled per our Privacy Policy, including its retention limits for abandoned drafts.
11. Fair Housing
Savoy Residential and the communities we manage comply with the federal Fair Housing Act and applicable Texas law. Applications are evaluated uniformly against the published Tenant Selection Criteria without regard to race, color, religion, sex, familial status, national origin, or disability. Reasonable accommodation and modification requests, including for assistance animals, are considered in accordance with applicable fair-housing law; contact us using the details in Section 13 to make a request.
12. Governing Law; Severability; Changes
These terms are governed by Texas law. Exclusive venue for disputes lies in the county where the community is located. If any provision is held unenforceable, the remainder stays in effect. We may update these terms prospectively; the version you accept at submission governs that application.
